Policies/Service Agreement:

Between Precisium and CUSTOMERNAME, hereafter referred to as the
Account Holder


1)Spam:
Precisium is firmly against the practice of sending bulk unsolicited emails.

The Account Holder will not use our email system for this purpose, nor use an email address located here as a return address for spam sent from another account, nor use unsolicited email to advertise a URL that is hosted on Precisium's systems.

This means that even if our email systems are not involved in the sending or receiving of unsolicited email, but the unsolicited mail refers to an address hosted here - this is grounds for account termination.

This hardline against spam is important to ensure that our systems remain available to the greater part of the internet. Even a few complaints about unsolicited email can have serious ramifications with respect to an ISPs connectivity.
There are various "blocking" systems in place around the net that can mark individual IP addresses, servers and even whole networks as being involved in spamming. Once our systems are placed in such lists - this can restrict the ability of all our customers to send and receive email from various other mailservers, and can even cause websites hosted here to become unviewable by some services.

2)CONTENT/CENSORSHIP:
Precisium hereby encourages the Account Holder to check the legality of all material, and if unsure, to seek legal advice.
Precisium does not consider that organisations such as Precisium should be expected by the law or by society to act as a 'second layer' of censorship, so does not currently intend to take action unless Precisium happens to encounter illegal material, or is instructed to take action by any relevant authorities.
By hosting a site with Precisium (WEBPUB.NET), the Account Holder agrees to hold full and sole responsibility for the legality of the content of the website whether the material is uploaded by the Account Holder or by an agent of the Account Holder, or by a member of the public utilising features of the site, enabled for the purpose of uploading. (e.g Discussion Boards)

3)PROVISION OF SERVICE:
Precisium attempts to maintain as close to 100% uptime as possible.
However, from time to time it is possible that outages will occur.
Precisium will refund any hosting costs at the rate of 1 days costs per Hour of downtime upon request, where '1 days costs' refers to the amount charged by Precisium to the Account Holder for provision of the WEBPUB.NET service for a period of 24 Hours.

4)DATA TRANSFER:
The Account Holder is limited to 100MB of outbound traffic per month and 20MB inbound for any Free Trial period, and to the amount relevant to the account-type held as specified on our rates page whilst the Holder of a paid-up account.

The Account Holder agrees that Precisium may terminate a Trial Account if the data transfer limits are exceeded, unless the Account Holder has notified Precisium in writing or by email that the Account Holder agrees to pay outbound data transfer costs over this amount at the standard plan rates.

For a paid-up account, the Account Holder agrees that unless explicit arrangements have been made to the contrary, Precisium will charge data transfers over the Plan allowance at the applicable plan rates as shown in our rates and services list, without the need for an explicit instruction to that effect from the Account Holder.
Any excess data transfer cost will appear on the next invoice.


5)PAYMENTS & REFUNDS:
See Item 4 with regards to outages.
Payments are to be made in Australian Dollars unless otherwise agreed between Precisium and the Account Holder.
Payments can be made on a monthly, quarterly,six monthly or yearly basis. The period will default to monthly unless requested otherwise by the Account Holder.
Invoices will be emailed at the chosen interval. Hard copies can be mailed out upon request.
Payment of invoices are due within 28 Days. The Account Holder agrees that Precisium may suspend the account if full payment is not received, and that Precisium may terminate the account if payment is not received within 60 Days.
If within 30 days of commencment of a paid-up account the Account Holder wishes to terminate the account for any reason, Hosting and Setup fees will be refunded, but any excess data transfer charges will still apply.

6)TERMINATION:
See item 5 with regards to Account-Holder initiated termination within 30 Days of commencement.
Violation by either party of any of the conditions of this agreement is grounds for immediate termination of the account,with refunds payable being equivalent only to portions of prepayments that have not yet been consumed.

7)CHANGE OF CONDITIONS:
Precisium reserves the right to modify any terms and conditions as it sees fit.
Precisium will notify Account Holders by email of such changes if such changes either reduce the available plan resources, or increase the price.
The Account Holder may terminate the account and will be eligible for a pro-rated refund of any prepaid amounts, if the Account Holder declares in writing or by email within 14Days of receiving notification of the change of terms and conditions, that the account is being terminated because the new conditions are unsuitable.


8)ACCEPTANCE OF TERMS & CONDITIONS:
By logging on, and making use of the offered Precisium services (WEBPUB.NET), the Account Holder agrees to the above conditions.
